Filep Sampaikan Masalah Pertanahan di Pabar ke Menteri ATR/BPN

JAKARTA, JAGAPAPUA.COM - Senator Papua Barat Dr. Filep Wamafma menyampaikan tujuh masalah pertanahan dan pengaturan tata ruang di Papua Barat kepada Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan (ATR/BPN) RI Hadi Tjahjanto. Hal itu diutarakan Filep Wamafma pada rapat dengar pendapat (RDP) Komite I DPD RI dengan Menteri ATR/BPN hari ini, Senin, 5 Juni 2023.

“Pertama, saya menyampaikan persoalan terkait status tanah perumahan di wilayah Sanggeng, Manokwari yang selama ini menjadi konflik antara masyarakat, pemerintah daerah dan juga TNI Angkatan Laut. Saya meminta agar Kementerian ATR/BPN segera melakukan advokasi dan langkah-langkah konkret dalam rangka memberikan jaminan kepastian hukum atas status tanah di wilayah Sanggeng itu sehingga persoalan yang ada dapat segera terselesaikan,” ujar Filep, Senin (5/6/2023).

Filep juga mendorong Kementerian ATR/BPN dan jajaran baik di tingkat provinsi maupun Kabupaten merespons cepat dan mengkaji secara mendalam hal-hal yang berpotensi menimbulkan persoalan pertanahan di tengah masyarakat.

Lebih lanjut, pimpinan Komite I DPD RI ini menuturkan bahwa Menteri/ATR BPN RI Hadi Tjahjanto berjanji dan berkomitmen untuk memastikan persoalan pertanahan tersebut segera ditindaklanjuti untuk dapat diselesaikan dengan baik.

“Pak menteri juga sampaikan bahwa beliau telah menyampaikan kepada Panglima TNI agar tanah-tanah yang digunakan oleh TNI dan Polri perlu ditinjau kembali guna memastikan tidak adanya pelanggaran hak atas kepemilikan tanah dan menghindari konflik antara masyarakat dan TNI-Polri. Kejelasan dan kepastian status hukum itu perlu disampaikan agar menjadi titik terang atas persoalan ini,” katanya usai RDP tersebut.

Kedua, Senator Filep juga meminta kepada Menteri ATR/BPN untuk melakukan evaluasi secara menyeluruh terhadap masalah status tanah bersertifikat ganda. Menurutnya, masalah ini juga akan menjadi bahan evaluasi Kementerian ATR/BPN sekaligus dalam rangka memperkuat fungsi Satgas Pemberantasan Mafia Tanah.

“Lalu pada poin aspirasi ketiga, yakni terkait dengan tanah pemukiman atau tempat tinggal masyarakat Mulyono yang dipindahkan dan dibangun rumah oleh TNI Angkatan Laut namun tidak memiliki status kepemilikan tanah. Masalah ini juga direspons baik oleh Pak Menteri dan akan masuk dalam agenda pembahasan dalam mengadvokasi persoalan di daerah,” sambung Filep.

Selanjutnya, yang keempat, Wakil Ketua Komite I DPD RI ini juga meminta Kementerian ATR/BPN dapat segera mengeluarkan sertifikat hak komunal sebagaimana arah kebijakan terkait realisasi reforma agraria yang saat ini menjadi atensi khusus Kementerian ATR/BPN.

“Kami juga mendorong penerbitan sertifikat hak komunal dapat segera direalisasikan. Kabar baiknya, ke depan dan dalam waktu dekat Kementerian ATR BPN akan melakukan penataan dan mengeluarkan serta menyerahkan sertifikat tersebut,” ujar Filep.

“Oleh sebab itu bagi saya, ini waktunya bagi masyarakat, untuk tanah yang sifatnya hak ulayat dapat segera dikoordinasikan dengan pemerintah daerah dan kelembagaan adat agar mempermudah Kementerian ATR/BPN menyelesaikan persoalan kepemilikan tanah-tanah yang sifatnya hak ulayat,” katanya lagi.

Tak hanya itu, wakil rakyat Dapil Papua Barat ini menyampaikan poin aspirasi kelima tentang izin pertambangan. Dirinya berharap agar Kementerian ATR/BPN dapat turut mendukung adanya tambang rakyat di Masni maupun Pegunungan Arfak (Pegaf) dengan mendukung peraturan daerah khusus (Perdasus) Provinsi Papua Barat.

“Tentu kami berharap adanya dukungan pemerintah dalam hal ini ATR/BPN terkait perizinan juga penggunaan kawasan-kawasan yang sifatnya khusus yang bisa dijadikan sebagai tambang-tambang rakyat. Terlebih, masalah tambang ilegal di Papua Barat juga belum tuntas, maka kami juga menginginkan kehendak masyarakat pemilik ulayat untuk dapat mengelola tambang rakyat dapat terpenuhi, lantaran hal itu berkaitan dengan sumber perekonomian rakyat setempat,” jelas doktor hukum alumnus Unhas Makassar itu.

Pada poin aspirasi keenam terkait dengan persoalan DOB provinsi, Filep berharap pemerintah dalam hal penataan ruang dapat memperhatikan kekhususan yang dimiliki provinsi di tanah Papua terutama yang berkaitan dengan hak-hak dasar orang Papua, seperti hak atas tanah dan sumber daya alam (SDA).

“Dengan memperhatikan kekhususan ini, kebijakan pengaturan tata ruang akan memberikan kenyamanan, kedamaian dan kesejahteraan, serta tidak memunculkan konflik baru antara masyarakat, investor maupun dengan pemerintah,” ucapnya.

Poin aspirasi ketujuh, Senator Filep menekankan perlu adanya sinkronisasi kebijakan dalam pengembangan potensi daerah seperti pembangunan kawasan ekonomi khusus, kawasan industri, termasuk industri pariwisata di Bumi Kasuari itu agar realisasinya sesuai dan konstruktif untuk meningkatkan perekonomian sekaligus memperhatikan keberlanjutan lingkungan dan ruang hidup yang sehat di daerah.

“Nah, beberapa contoh yang kita sampaikan seperti masalah pengembangan kawasan industri di Papua Barat, soal provinsi konservasi yang juga membutuhkan pengaturan dan sinkronisasi kebijakan agar realisasinya tepat dan saling mendukung. Sehingga jangan sampai perdasus yang mendapatkan apresiasi PBB terkait dengan lingkungan ini kemudian tidak bermanfaat karena adanya Kawasan Industri,” katanya.

“Maka kebijakan yang seirama ini juga diharapkan mencakup wilayah pengembangan di masing-masing daerah sesuai branding yang dicanangkan misalnya pemerintah harus konsisten dan sinkron soal penataan ruang di Bintuni, Sorong dan pariwisata yang ada di Raja Ampat,” tutup Filep.
